1. Overview

GetLoops (“we”, “us”, “our”) is a platform that allows users to upload, share, discover, and download audio loops and samples.

Some uploads may include custom licensing terms such as revenue splits or usage restrictions defined by the uploader.

By using GetLoops, you agree to these Terms. If you do not agree, you should not use the platform.

2. Eligibility

You must be at least 13 years old to use GetLoops. If you are under 18, you must have permission from a parent or guardian.

3. Accounts

To access some features, you may need to create an account. You agree to:

• Provide accurate information
• Keep your login secure
• Be responsible for activity under your account

We may suspend accounts that violate these Terms or harm the platform or other users.

4. User Content

You retain ownership of any audio, loops, metadata, or other content you upload (“User Content”).

By uploading content, you grant GetLoops a non-exclusive, worldwide licence to:

• Host, store, reproduce, and distribute your content
• Display and make it available to other users on the platform
• Operate and promote the service
• Analyse, process, transform, and create derived data from your User Content for the purposes of operating, improving, developing, and enhancing GetLoops and its services, including the development of technologies and tools based on aggregated or derived information

This licence exists only while your content is on GetLoops.

You retain ownership of your User Content, but you grant GetLoops a worldwide, perpetual, irrevocable, sublicensable licence to use, reproduce, modify, analyse, and commercialise metadata generated through the service (including technical or derived data such as key, BPM, waveform, loudness, and similar analysis output). This generated-metadata licence survives deletion of your content or account and is independent of the User Content licence above.

GetLoops may use aggregated, anonymised, or otherwise derived information from User Content for research, development, analysis, and commercial purposes. Such information may be shared with or licensed to third parties.

You confirm that:

• You own or have the rights to upload the content
• Your content does not infringe any third-party rights
• Your content is not illegal or unlawful

5. Licensing & Splits (IMPORTANT)

Some uploads may include custom requirements set by the uploader, such as revenue splits or royalty percentages.

By using these features, you acknowledge and agree that:

• The "Splits" displayed on GetLoops are declarations made by the uploader for informational and licensing purposes; the platform does not automatically generate or attach formal legal contract documents to these uploads.
• You are solely responsible for defining, understanding, and adhering to the licensing terms or splits associated with any content you upload or download.
• GetLoops acts strictly as a distribution platform and is not a party to any private agreements or disputes regarding revenue sharing, royalties, or usage rights.
• GetLoops is not legally responsible or liable for any user's failure to honor their declared splits or licensing commitments.

By downloading or using content, you agree to respect the terms declared by the creator. While we do not enforce legal agreements between users, we reserve the right to remove content or accounts that repeatedly violate platform rules or act in bad faith.

6. Prohibited Content, Promotion & Content Moderation

You must not upload or share content that:

• You do not have rights to use or distribute
• Infringes copyright or trademarks
• Contains malware or harmful code
• Is illegal, hateful, abusive, or harassing
• Violates privacy of others
• Attempts to manipulate or damage the platform
• Uses loop titles, descriptions, tags, artwork, audio, profile information, or other content fields to advertise, market, promote, solicit, or redirect users to third-party products, services, websites, social-media accounts, affiliate offers, or other commercial activity unrelated to the genuine sharing or licensing of the loop
• Constitutes spam, deceptive promotion, keyword stuffing, or other misuse of GetLoops as an advertising channel

To the fullest extent permitted by applicable law, GetLoops may review, reject, unpublish, restrict the visibility of, disable access to, or permanently delete any User Content, including loops and associated metadata, at any time and with or without prior notice. We may take such action where, in our reasonable judgment, the content violates these Terms, is promotional or misleading, is unsuitable for the platform, creates legal, operational, or reputational risk, or otherwise conflicts with the purpose or interests of GetLoops or its community.

We may also remove User Content that, in our judgment, does not meet our technical, editorial, audio, production, metadata, or overall quality standards. GetLoops is not obligated to host, preserve, or continue distributing any User Content. Except where applicable law requires notice or a statement of reasons, we are not required to provide a reason for a moderation or removal decision. We may suspend or terminate accounts associated with repeated or serious violations.

GetLoops' review or approval of uploaded content is for quality, formatting, and platform-fit purposes only, and does not constitute a guarantee, warranty, or legal determination that the content is free of third-party rights claims. Uploaders remain solely responsible for the legality of their content regardless of approval status.

7. Copyright Complaints

If you believe content on GetLoops infringes your copyright, contact us at:

Include:

• Identification of the work
• Link or description of the infringing content
• Your contact details
• A statement that you believe the use is not authorized

We will review and act on valid requests under applicable copyright law.

8. Service Availability

We try to keep GetLoops running smoothly, but we do not guarantee:

• Uninterrupted access
• Error-free operation
• That content will always be available

9. Termination

You may delete your account at any time. We may suspend or remove accounts that:

• Violate these Terms
• Harm other users
• Abuse the platform

Where reasonable, we may warn you before taking action.

10. Liability

To the maximum extent allowed by law:

• The service is provided “as is”
• We are not responsible for indirect or incidental damages
• We are not liable for disputes between users regarding uploaded content or licensing terms

You agree to indemnify and hold GetLoops harmless from any claims, damages, or costs (including legal fees) arising from your uploaded content, including claims that it infringes third-party rights.

Notwithstanding the above, you listen to any audio recordings made available on the Website at your own risk. Extensive or prolonged listening to audio recordings at high volumes may result in hearing degradation or loss; please use the Website responsibly.

11. Changes

We may update these Terms occasionally. If changes are significant, we will notify users in advance where reasonable.

Continued use of the platform means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of Portugal and applicable European Union law.
